Terms & Conditions
These terms govern your use of Monte Olea and our annual olive tree adoption program, including subscriptions, personalized items, shipment claims, and customer accounts.
Introduction
These Terms & Conditions ("Terms") govern your access to and use of the Monte Olea website, customer account, olive tree adoption program, products, and related services (together, the "Services").
By visiting our website, creating an account, purchasing or receiving an adoption, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility and acceptance
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase an adoption or create an account. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for ensuring that your use of the Services is lawful where you live and that the information you provide is accurate, current, and complete.
Our services
Monte Olea offers annual olive tree adoption plans. The benefits shown for the plan you select at checkout may include:
- Care of one or more olive trees in our Puglia grove.
- An annual allocation of extra virgin olive oil in the amount stated for your plan.
- Two or four seasonal shipment opportunities, depending on the plan.
- One personalized ceramic bottle with the first shipment and refill packaging for the remaining included oil.
- A personalized adoption certificate and seasonal grove updates.
The plan details and price displayed at checkout form part of these Terms. We may improve, replace, suspend, or discontinue features that are not essential to an active paid adoption.
The adoption program
Adoption period
Each paid adoption covers one annual period beginning on the date established by the applicable subscription transaction. Benefits and shipment allocations are tied to that paid period.
No ownership interest
An adoption is a sponsorship and product-and-service subscription. It does not transfer legal title to any tree, crop, land, equipment, or other property. All trees and grove property remain owned or controlled by Monte Olea or its partners.
Tree and grove assignment
We assign trees or a grove area based on availability and agricultural needs. We may reassign or replace a tree when reasonably necessary because of tree health, weather, cultivation, land management, or other operational circumstances.
Harvest and oil allocation
Farming is affected by weather, pests, disease, yield, harvest timing, and other natural conditions. Your included olive oil is allocated from the relevant Monte Olea grove harvest and is not necessarily produced exclusively from the specific tree or trees associated with your adoption. If a harvest is insufficient, we may provide comparable olive oil from another Monte Olea harvest or partner source, or offer another reasonable remedy.
Annual subscription and cancellation
Automatic renewal
Unless the checkout page expressly states otherwise, adoption plans are annual subscriptions. Your subscription renews automatically at the end of each paid annual period using your saved payment method, at the price then disclosed for your plan, until canceled. Where required by law, we will provide notice of a material price change before it takes effect.
Canceling renewal
You may schedule cancellation through the billing controls available in your account or by contacting support. Ordinary cancellation takes effect at the end of the current paid annual period. It does not automatically refund or prorate that period, and your paid benefits continue through its end, subject to these Terms.
Payment failure
If a renewal payment fails or is reversed, we may retry payment, request an updated payment method, suspend unfulfilled benefits, or end the renewal, as permitted by law. We may pause fulfillment while a refund, dispute, fraud concern, or billing error is reviewed.
Pricing and payment
Prices and taxes
Adoption prices are displayed in U.S. dollars unless stated otherwise. Prices may change for future purchases or renewal periods. Shipping, optional packaging, taxes, duties, and other charges are separate where disclosed and are your responsibility to the extent permitted by law.
Payment authorization
By submitting a payment method, you authorize our payment provider to charge all amounts shown at checkout and, for a subscription, applicable renewal charges. You represent that you are authorized to use the payment method and that the billing information is accurate.
Third-party payment processing
Payments are handled by third-party payment providers and may be subject to their terms. We are not responsible for a provider's independent services, but this does not limit any rights you have against Monte Olea under applicable law.
Shipment claims and delivery
Shipment schedule
Your plan includes the number of seasonal shipments disclosed at purchase. Shipment opportunities are released through your account during the paid annual period. You must sign in, choose an eligible destination, and complete the shipment claim before we can prepare and dispatch a shipment.
Shipping charge and destination
Each shipment requires a separate $14.90 shipping payment before tax, unless we expressly state otherwise. Each complete shipment must go to one address, although you may choose a different eligible address for a later shipment. Available destinations may change based on carrier, export, tax, and regulatory requirements.
Ceramic bottle and refills
The first shipment for an adoption includes one complimentary personalized ceramic bottle; the rest of its oil allocation is packaged as refills. Later shipments use refill packaging by default. Where offered, you may replace one included 500 ml refill in a later shipment with a filled personalized ceramic bottle for $29.90 before tax. This replacement does not increase your included oil volume.
Delivery details
You must provide a complete and accurate address and review it before payment. Delivery dates are estimates and may be affected by harvest operations, weather, customs, carriers, peak periods, or events outside our reasonable control. Title and risk of loss pass as provided by applicable law.
Duties and import requirements
International delivery may be subject to customs procedures, duties, taxes, import restrictions, or recipient-identification requirements. You are responsible for charges and cooperation required from the recipient unless applicable law or the checkout page states otherwise.
Returns, damage, and refunds
Adoption assignments, certificates, and ceramic bottle labels are personalized, and olive oil is a food product. Purchases are therefore generally final once processing or fulfillment has begun, except where applicable law requires a cancellation, return, replacement, or refund.
If a shipment arrives damaged, defective, incorrect, or incomplete, contact us within seven days of delivery with your order details and, where possible, photographs of the package and product. We will assess the issue and may replace the affected item, issue a refund, or provide another appropriate remedy.
Other refund requests are considered case by case. Canceling an annual renewal does not by itself create a refund for the current paid period or for fulfilled benefits.
Customer accounts
Some Services require an account. You must provide accurate information, maintain the confidentiality of your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our failure to use reasonable care.
You may not share, sell, transfer, or misuse account access. We may require email verification or other reasonable steps before allowing access to purchases, billing controls, personal information, or shipment benefits.
Personalization and gifts
You are responsible for names, messages, and other content submitted for certificates, bottle labels, and gifts. You must not submit content that:
- Is unlawful, threatening, defamatory, hateful, or obscene.
- Infringes intellectual property, privacy, or other rights.
- Impersonates another person or is deceptive or fraudulent.
- Contains malicious code or instructions intended to cause harm.
You grant us a limited right to use submitted content only as needed to provide the requested personalization and Services. We may reject or adjust content that violates these Terms or cannot be produced reliably.
If you provide another person's information for a gift, you represent that you are authorized to do so and will not use our Services to send unwanted or unlawful communications.
Intellectual property
The website and its content, including text, photographs, graphics, branding, designs, software, and other materials, are owned by Monte Olea or its licensors and are protected by intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access the Services for personal, non-commercial use. You may not copy, modify, distribute, sell, sublicense, reverse engineer, scrape, or create derivative works from the Services except as expressly permitted by law or by our written consent.
Prohibited uses
You agree not to:
- Use the Services for an unlawful or fraudulent purpose.
- Circumvent authentication, payment, security, rate limits, or access controls.
- Interfere with the website, introduce malicious code, or overload our infrastructure.
- Access another person's account or information without authorization.
- Use automated means to extract data or content without our written permission.
- Resell the Services or use our content or branding commercially without authorization.
Third-party services
The Services may link to or depend on third-party websites, payment providers, carriers, or platforms. Their services are governed by their own terms and privacy practices. We do not control and are not responsible for independent third-party services, except to the extent applicable law provides otherwise.
Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." We do not guarantee that the website will always be uninterrupted, error-free, or free from harmful components, or that every non-essential feature will remain available.
Agricultural appearance, yield, harvest timing, flavor profile, and other natural characteristics may vary. Product photographs and illustrations are representative, and colors and packaging may appear differently depending on production runs and display settings.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by law, Monte Olea and its affiliates, officers, employees, agents, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, use, or goodwill, arising from the Services.
To the maximum extent permitted by law, our aggregate liability for a claim relating to the Services will not exceed the amount you paid Monte Olea for the affected Service during the twelve months before the event giving rise to the claim.
These limitations do not apply to liability that cannot be limited or excluded under applicable law, including any mandatory consumer protections.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Monte Olea and its affiliates, officers, employees, agents, and partners from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your content, or your material violation of these Terms or another person's rights.
Governing law and disputes
These Terms are governed by the laws applicable in the jurisdiction where Monte Olea operates, without regard to conflict-of-law rules, except where the mandatory law of your residence applies.
Before filing a formal claim, please contact us so we can try to resolve the issue in good faith. Any unresolved dispute may be brought before a court of competent jurisdiction. Nothing in these Terms restricts rights or remedies that applicable consumer law does not permit you to waive.
Suspension and termination
You may stop using the Services at any time, but stopping use does not cancel a subscription or payment obligation unless you complete the applicable cancellation process.
We may suspend or terminate access when reasonably necessary to protect customers or the Services, investigate fraud or payment disputes, comply with law, address a material breach, or discontinue the Services. Where appropriate, we will provide notice and an opportunity to remedy the issue.
Changes and general terms
We may update these Terms from time to time. We will post the revised Terms and update the date above. Where required, we will provide additional notice before material changes apply. Continued use after an updated version takes effect constitutes acceptance of the revised Terms.
If any provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization or transfer of our business.
These Terms, the Privacy Policy, and the plan and checkout details presented to you form the entire agreement regarding the Services and supersede prior understandings about the same subject.
